Biden's DOJ Files Specious Arguments to Keep Biden's Audio Hidden
President Joe Biden mishandled classified documents during his tenure in the US Senate, as vice president, and as a private citizen. There is no doubt about that -- it happened. Biden had stacks of documents in his Delaware home, boxes of classified docs in his garage, and mounds of classified material, none of which were declassified because he had no authority to declassify any document before 2021. Yet he avoided prosecution. Reasonable people ask, “Why?”
When Special Counsel Robert Hur concluded his investigation of Joe Biden’s blatant and obvious violation of the law, America learned the “why” of how Joe Biden had left Hur with the impression that Joe was a doddering, foolish old man with a poor memory and that a jury would have sympathy on the bumbling octogenarian. A conviction was unlikely when faced with a lump of a slurring and forgetful old man sitting at the defendant’s table.
Biden’s White House tried to have Hur sanitize his remarks because the report had already been issued. When the public read the report, the White House Comms team and Democrat apparatchiks leapt to Joe’s defense claiming that he was fully in control and that Hur had, in essence, lied. For instance, Biden and his acolytes claimed that Hur had brought up Biden’s son Beau.
In response, Hur released the transcript of the deposition, which confirmed that Biden had, once again, misrepresented key facts. Biden brought up his son, not Hur’s team. Further, Biden struggled to understand questions and answer those queries.
The transcript was unassailable. Biden had, on paper, struggled to answer questions. The White House had hoped that would be the end of it. Biden had escaped prosecution for mishandling documents. Biden thought he had avoided the public hearing from Joe in his own words. There was an audio recording of Biden’s deposition. When Republicans and an interested public asked to hear the recording, the DOJ refused. But why?
Judicial Watch is a public watchdog that does yeoman's work in uncovering what public officials wish to keep hidden from the citizens. When Attorney General Merrick Garland refused to release the audio of Biden’s struggles, they filed suit.
On Friday, Judicial Watch found out that Biden’s lap dog of a DOJ is refusing to release the transcripts for three reasons: privacy, “AI might alter Biden’s voice,” and Executive Privilege.

Judicial Watch announced that the White House admitted in a federal court that the transcript of President Joe Biden’s testimony to Special Counsel Robert Hur is not accurate and is missing “filler words (such as ‘um’ or ‘uh’)” and words that “may have been repeated when spoken (such as ‘I, I’ or ‘and, and’)” which were sometimes “only listed a single time in the transcripts.” In its new filing the Biden Justice Department makes the extraordinary assertions of executive privilege and privacy to hide the Biden audio. The agency makes the unprecedented assertion that because “AI” could be used to alter Biden’s words the material should be kept secret.
All stated reasons are specious. The transcripts have been released, so claiming Biden has a privacy issue when his words are already public is nothing short of absurd. Claiming that Biden’s voice could alter what Biden actually said is a remarkably silly argument. AI can be used to do that with just the transcripts. In fact, releasing the audio would make any AI alteration “mute.” And lastly, Executive Privilege is utterly ridiculous because the public has the transcript.
What Judicial Watch has now revealed is that even the transcript isn’t accurate. It has been altered so Biden’s obvious fumbling to answer questions doesn’t confirm that he is a doddering old man. It further confirms that the DOJ is acting—not for the public's interests—but for Biden's self-interest. The DOJ doesn’t want the audio released because it will undoubtedly confirm that Hur, in one respect, was right. Biden is a shaky old man who has no business sitting in the Oval Office.
Releasing the audio will lay bare that Biden isn’t fit for office. Any office, let alone the Chief Executive of the United States.
I have taken hundreds for depositions, and the most damning are those that the trier of fact can see with their own eyes and hear with their own ears. Video is best, but audio is the next best thing. I have zero doubt that if the public was allowed to hear Biden speak, most people would be stunned at how incompetent he sounds. Biden has trouble with basic simple tasks like answering basic, simple questions.
Releasing the audio might not be the sound of Joe's death rattle, but it might be close to convincing those on the fence that Biden is simply not fit for office.
