General Miley/The US Code

 There is no attribution for this thread. It is provided for information on legal definition of the terms being presented on the information coming from Bob Woodward’s new book. 

Yesterday 0844MOS posted a thread implicating General Miley, heretofore to have the moniker Milquetoast Miley, in possible ‘treason’, or at a minimum sedition. 

To, again, provide what has caused these possible charges, here is a copy of what is contained in the book by Bob Woodward, from whence these, possible, charges arise. 

“General Li, I want to assure you that the American government is stable and everything is going to be okay,” Milley told him. “We are not going to attack or conduct any kinetic operations against you.”

In the book’s account, Milley went so far as to pledge he would alert his counterpart in the event of a US attack, stressing the rapport they’d established through a backchannel. “General Li, you and I have known each other for now five years. If we’re going to attack, I’m going to call you ahead of time. It’s not going to be a surprise.”

For clarity’s sake,  herewith are the definitions of Treason and mutiny or sedition as they appear in the US code.

10 U.S. Code § 894 -UCMJ Art. 94. Mutiny or sedition

(a)Any person subject to this chapter who—

(1)with intent to usurp or override lawful military authority, refuses, in concert with any other person, to obey orders or otherwise do his duty or creates any violence or disturbance is guilty of mutiny;

(2)with intent to cause the overthrow or destruction of lawful civil authority, creates, in concert with any other person, revolt, violence, or other disturbance against that authority is guilty of sedition;

(3)fails to do his utmost to prevent and suppress a mutiny or sedition being committed in his presence, or fails to take all reasonable means to inform his superior commissioned officer or commanding officer of a mutiny or sedition which he knows or has reason to believe is taking place, is guilty of a failure to suppress or report a mutiny or sedition.

(b)A person who is found guilty of attempted mutiny, mutiny, sedition, or failure to suppress or report a mutiny or sedition shall be punished by death or such other punishment as a court-martial may direct.

18 U.S. Code § 2381 – Treason

Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States.

Frankly, my personal opinion is this will, very unfortunately, go nowhere.
