Fifth Circuit Strikes Down Law Forbidding Gun Ownership by Drug Users

The Bruen decision is still bearing fruit; in the latest episode, the Fifth Circuit Court has struck down a law forbidding known drug users from possessing firearms.

A federal appeals court on Wednesday struck down a decades-old law barring users of illegal drugs from possessing firearms – the latest blow to US gun regulations after the Supreme Court cleared the way last year for courts to reexamine the nation’s gun laws under a new legal standard.

In a unanimous judgement from a three-judge panel at the New Orleans-based appeals court, the court said the 1968 law is unconstitutional, citing a landmark 2022 Supreme Court decision that changes the framework that lower courts must use when analyzing gun restrictions.

“In short, our history and tradition may support some limits on an intoxicated person’s right to carry a weapon, but it does not justify disarming a sober citizen based exclusively on his past drug usage,” Circuit Judge Jerry Smith, a Ronald Reagan appointee, wrote for the panel. “Nor do more generalized traditions of disarming dangerous persons support this restriction on nonviolent drug users.”

The case was brought by one Patrick Daniels, who was found in possession of two firearms and several marijuana butts. He was not tested, and there is no indication he was impaired, but he did admit to having used marijuana and so was arrested and sentenced to four years in prison. Daniels’ conviction has now been overturned, and other similar cases in the area under the jurisdiction of the Fifth Circuit (Louisiana, Texas, and Mississippi) may be challenged as well.

Interestingly, this is the same law under which Hunter Biden was charged with possession of a firearm by a drug user.

The judgment also means that other defendants convicted under the law within the 5th Circuit Court of Appeals’ jurisdiction could seek to challenge their convictions under the new ruling. The circuit covers Louisiana, Texas and Mississippi.

The statute examined by the 5th Circuit was one of the laws that federal prosecutors alleged Hunter Biden violated with a gun purchase in 2018. The Justice Department made the allegation as part of a proposed deal with the president’s son that also covered certain alleged tax crimes, but the agreement is now being scrutinized by a federal judge in Delaware. Biden has pleaded not guilty.

It’s interesting to consider the implications of this.

This is, of course, more fruit of the Bruen decision, and there will doubtless be more such cases brought. There has been a landmark change in how courts have to look at Second Amendment cases. In the Daniels case, the Bruen decision was published while his case was actually ongoing; as Bruen strengthened legal precedent recognizing the Second Amendment as a fundamental guarantee of the individual citizen’s right to keep and bear arms, the Daniels case was called into question, and similar cases will be as well – including, possibly, Hunter Biden’s case.

Second Amendment arguments aside, there is a due process argument to be made. It’s important to note that Daniels was not given a drug test; there is no indication that he was impaired at the time of the traffic stop; he was convicted, and his Second Amendment rights denied, based solely on the evidence of some marijuana remnants and his own admission. This seems shaky ground for the lifelong denial of a fundamental liberty.

Also, there is the larger picture to consider. The Bruen decision has far-reaching consequences. We are only beginning to see all of the implications this decision will have, not only on concealed-carry laws but on Second Amendment issues as a whole. It may even bring long-standing laws like the 1968 Gun Control Act into question.

We have not yet seen the last legal implications of Bruen. Far from it.

Who Will Say No More to the Current Madness? ~ VDH

We need an American Leo Amery to stand up


Britain slept in the 1930s as an inevitable war with Hitler loomed.

A lonely Winston Churchill had only a few courageous partners to oppose the appeasement and incompetence of his conservative colleague Prime Minister Neville Chamberlain.

One of the most stalwart truth-tellers was a now little remembered politico and public servant Leo Amery, a polymath and conservative member of Parliament.

Yet in two iconic moments of outrage against the Chamberlain government’s temporizing, Amery galvanized Britain and helped end the government’s disastrous policies.

In the hours after Hitler invaded Poland on September 1, 1939, there was real doubt whether Chamberlain would honor its treaty and declare war on Germany.

A Labour Party member, surrogate Arthur Greenwood, got up in the House of Commons to announce that he would be speaking for Labour on behalf of his ill party leader Clement Attlee.

Immediately Amery interrupted, shouting out, “Speak for England, Arthur!”

He was met with overwhelming applause and soon public acclamation.

After all, Amery was a political voice in the wilderness warning that neither his own party nor opposition Labour was speaking or acting for the real interest of the British people.

Amery, a shocked Greenwood, and others had finally had enough of the partisan nonsense, and demanded the nation unite against Nazi Germany.

Britain hours later declared war on Germany, the first major power to do so.

On a second iconic occasion on May 7, 1940, Amery voiced even stronger views—again, widely held by the public, but rarely voiced by the timid political class.

The inept Chamberlain government had just lost a winnable Norway campaign to Germany.

Amery responded with a blistering attack on the incompetence of the conservative Chamberlain administration by quoting Oliver Cromwell’s hallmark 1653 order to the Long Parliament:

“You have sat too long here for any good you have been doing. Depart, I say, and let us have done with you. In the name of God, go.” 

Three days later after Amery’s speech and the invasion of France, an ill Chamberlain and most of his advisors resigned. Churchill became Prime Minister. The rest is history.

We need a voice like Amery’s. Like Britain from 1939 to 1940, America is in existential danger.

The Biden administration has utterly destroyed the southern border—and immigration law with it.

Biden green lighted 7 million illegal aliens swarming into the U.S. without legal sanction or rudimentary audit.

China spies inside and over the U.S. with impunity. Beijing has never admitted to its responsibility for the gain-of-function Covid virus that killed a million Americans.

President Biden printed $4 trillion at exactly the wrong time of soaring post-COVID consumer demand and supply shortages. No wonder he birthed the worst inflation in 40 years.

In response, interest rates tripled, gas prices doubled.

Our military is thousands of recruits short. It lacks sufficient munitions.

Following Biden’s humiliating pullout from Afghanistan, vast troves of arms were abandoned in Kabul. Billions more in scarce weapons were sent to Ukraine.

The Pentagon’s woke agenda trumps meritocracy in promotions and advancement.

Our enemies—Russia, China, Iran, North Korea—are on the move, while the U.S. seems listless.

The Biden renegade Department of Justice, CIA and FBI have become weaponized. Ideology, politics, and race—not the law—more often guide their investigations, intelligence operations and enforcement.

The downtowns of our once majestic major cities are becoming unlivable.

They are mired in refuse and trash, violent crime and homelessness. Stores and businesses leave. Millions each year flee the blue urban coasts to the red west and south.

To even say there are still two biological genders, that global warming may not be entirely manmade or necessarily destroying the planet, or that class, not race, is the proper barometer of inequality is to face ostracism and career cancellation.

The public assumes that President Biden is severely cognitively challenged, likely corrupt, and a serial fabricator.

Most know what must be done, but few will tell the truth: Balance the budget. Return to legal only immigration. Restore a well-funded, but unwoke Pentagon.

Insist on racial unity. Curb the overweening administrative state. Enforce the rule of law.

Produce more gas and oil. Reestablish civic education. Insist universities protect free speech and due process—and stop proselytizing.

In other words, restore what until recently made America the strongest, most prosperous, and freest nation in the world. And quit undoing all the great good that eight generations of prior Americans bequeathed to us.

Somewhere out there an American Leo Amery is growing infuriated over what is being done to America.

And if he finally stands up like Amery to call out our bankrupt political class, the American people will echo his famous order to this disastrous government:

Depart, I say, and let us have done with you. In the name of God, go.”

With the release of another memo by Rep. James Comer came more revelations of just how enriched the Biden family became while Joe Biden was serving as vice president.

According to RedState’s reporting, a Russian oligarch named Yelena Baturina paid a Hunter Biden-created shell company $3.5 million.

The committee staff also uncovered new details in how Baturina, one of the wealthiest women in the world, paid $3.5 million to a shell company affiliated with Hunter Biden and his partner Devon Archer called Rosemont Seneca Thornton. Then, $1 million was siphoned off to Archer, while the remnant went to another venture called Rosemont Seneca Bohai.

It’s what happened after that which takes this disclosure from concerning to damning. In 2014, just after that incredibly large payment was made, Joe Biden showed up at a dinner at Cafe’ Milano where he met for an extended period of time with various business associates of his son. Who was one of those associates? Yelena Baturina.

“President Biden is compromised or corrupt, and our national security is threatened,” Comer said.

“This is made clear by meals at Café Milano where then-Vice President Joe Biden dined with oligarchs from around the world who had sent money to his son,” the chairman said.

Ask yourself, what did Baturina get in exchange for her $3.5 million payment? Hunter Biden and Devon Archer were not selling a product. They weren’t even selling their own advice or expertise. Rather, as Archer testified under oath, they were selling the “brand.” And who was the only member of the “brand” with any value? That would be Joe Biden, the then-Vice President of the United States.

Democrats continue to assert that the now-president was completely unwitting in all this. You see, he was just randomly jumping on business calls to talk about the weather and showing up at dinner with Russian oligarchs who had paid his family millions by sheer chance. No one who is intellectually honest actually believes that, though.

Then there’s the other dot that connects perfectly in all this, which is Hunter Biden complaining about having to pay his father’s bills.

House Republicans are never going to come across a check written out to Joe Biden for “bribes and beers.” The intricate network of shell companies his family put in place existed for a reason. How much of the money that went through them ended up paying for Joe and Jill Biden’s expenses? It’s likely that can be ascertained with further investigation of bank records, but to get those (especially related directly to the president), House Republicans are going to need to take the next step.

To this point, I’ve been rather understanding of the delays in beginning an impeachment inquiry of Joe Biden. Because the Republican House majority is so small, any mistake in the process could lead to a failure to pass eventual articles of impeachment on the floor. With that said, we now have millions of dollars being paid to the Biden family by a Russian oligarch, who then garnered an in-person meeting with Joe Biden. We also have Hunter Biden complaining that he was paying his father’s bills during the same time period. That is more definitive than anything raised during Donald Trump’s first impeachment.

An impeachment inquiry is the first official step in impeaching Biden, and it’s time to take that step. House Speaker Kevin McCarthy has already set several deadlines to do so that have come and gone. He can’t keep kicking the can down the road and expect to retain support. To do so would be a betrayal that not only could cost him his leadership position but could also cost Republicans the House in 2024. We have arrived at put-up or shut-up time.



Love Gives You Blinders

No matter the evidence linking Joe Biden to corruption, 
the love-struck media will look the other way

Last week, right-leaning websites blasted the American corporate media for downplaying the revelations from Hunter's business partner Devon Archer's closed-door testimony before the Oversight Committee last Monday.


But I don’t know why they bother.


The media’s job is to turn a blind eye to Democrat corruption.


In his testimony, Archer revealed that Hunter placed his father on speakerphone to chat with his prospective business associates about 20 times.


Rather than acknowledge that Joe Biden has repeatedly lied about having any involvement in his son's foreign business dealings, the media latched onto Democrat Congressman Dan Goldman's spin to portray the revelation as a great, big nothing burger.


They were casual conversations, the media reported. They only talked about the weather. No business was discussed.


The media also claimed that Archer told the Oversight Committee that Hunter was selling the "illusion" of influence, only Archer wasn’t the one who said that during the hearing. According to the transcript, Dan Goldman was the one who said it.


But the facts are irrelevant. Goldman's protestations were enough for the media to turn a blind eye to what Archer revealed.


Any thinking person would hear about those phone calls and conclude that Hunter and his dad were sending the clear message that the ear of Joe Biden is part of what they’re paying for.


Yesterday, Oversight Committee Chair James Comer released a memo showing that when Joe Biden was vice president, the Biden family and their associates raked in more than $20 million from countries like Russia, Ukraine, and Kazakhstan.


The desperate media quickly pointed out that the memo did not show any of that money going directly to Joe Biden.


So?


There are plenty of indirect routes that money could take on its way to the Big Guy.


According to an April 2022 report in the New York Post, Hunter Biden frequently paid the family's expenses and admitted to giving part of his salary to Joe.


In one text message to his daughter Naomi, Hunter told her, that "unlike pop [AKA Joe], I won't make you give me half your salary."


While no foreign payment went directly to Joe Biden, it is entirely plausible that Joe got a share of what was directly sent to Hunter.


And what he didn't get in cash, Joe got in expenses.


As the New York Post reported:

The expenses are spelled out in an email to Hunter from business partner Eric Schwerin from June 5, 2010, titled “JRB Bills.” They concerned the upkeep of Joe Biden’s palatial lakefront home in the wealthy Greenville enclave of Wilmington, Del. JRB are President Biden’s initials.

There were $1,239 in repairs to an air conditioner at “mom-mom’s cottage,” and another $1,475 to a painter for “back wall and columns at the lake house.” There was also another $2,600 for fixing up a “stone retaining wall at the lake” and $475 “for shutters.”

But unless there is photographic evidence of a foreign oligarch showing up at Biden's Wilmington house carrying a canvas bag with a great big dollar sign on the side, the news media will pretend this gun isn't smoking.


The media will also ignore the mounting evidence that foreign business associates were paying Hunter that money in exchange for Joe Biden's ear.


According to Comer's memo, shortly before being invited to dine with then-Vice President Joe Biden at DC's posh Café Milano in 2014, Russian billionaire Yelena Baturina wired $3.5 million to Hunter's firm Rosemont Seneca.


Was dinner with The Big Guy a reward for forking over $3.5 million?


Just a coincidence, I'm sure.


I mean, they just talked about the weather, right?


As a side note, did you know that Yelena Baturina is one of the few Russian oligarchs the Biden administration has not sanctioned since Russia invaded Ukraine?


Huh.


Again, probably just a coincidence.


There's no point heading down the "Imagine if the Trumps" cul-de-sac.


We all know that the same reporters and news outlets acting like nit-picking pillocks over James Comer's investigation spent four years happily lapping up every silly claim from Adam Schiff.


It isn't hypocrisy.


In both cases, the media is equally mission-focused.


During the Trump presidency, the media's mission was to take Trump down no matter what. And, by golly, they stuck to their mission even when doing so meant ending up looking like gormless prats.


Today, the media's mission is to protect Joe Biden no matter what. 


And once again, these guys are so committed to their mission that they are willing to ignore flashing red flags and deafening klaxons.


Is it frustrating?


Hell, yeah. It's frustrating.


Is it surprising?


Not even a little.


Jesse Kelly often tells the furious Trump supporters who lose their marbles whenever he utters even the mildest criticism of their guy that they're only upset because "you're in love and love gives you blinders."


The same thing can be said of the American corporate media.


Admittedly, the media doesn't love Biden as much as Trump fans love Donald Trump. Hell, nobody loves anything as much as Trump fans love Donald Trump.


But as the old saying goes, ya gotta dance with the one that brung ya.


It's a marriage of convenience.


Joe Biden is the only ticket in town. For good or ill, the corporate media is stuck with him if they want to ensure that the Republicans don't win.


And if that means turning a blind eye to evidence of corruption, bribery, and other high crimes and misdemeanors, then so be it.
