There Is Nothing Democrats Will Not Ruin


Is there a place in the country better off because Democrats have control over the local or state government? I mean, I guess if your hobby is getting pregnant so you can have an abortion, living in Chicago or Boston is a plus, but not if you’re a fan of things like not being robbed or shot. Otherwise, only slumlords and progressive “organizers” thrive in a world controlled by the left. And if you want to get your kid an education, forget about it. There is nothing Democrats can’t ruin, and there is nothing even potentially good they will not ruin.

You’ve all heard about “equity,” Democrats present the word like it’s the cure for something, anything. They pretend it is about opportunity when it is about outcomes. Democrats want to dictate outcomes – pick winners and losers, rewarding their donors while ignoring their voters, whom they take for granted. OJ Simpson treated women better than Democrats treat their voters. 

But hey, they keep voting for Democrats, so why be effective when you don’t have to be? 

Back to equity. 

San Francisco, the progressive Petri dish from which so many bad ideas spring, is implementing “equitable grading” in their schools. Why? Because minority students are not doing as well as Asian students, who are also minorities. (As an aside, it always cracks me up when Democrats talk about how racist the country is; they whine about how well Asians and Indians are doing. Are we racist or not? Because if we were, why are two minorities out-earning evil whitey?)

What is “equitable grading”? It is a scheme to cover up just how badly Democrats have screwed up the education system in their cities by lowering standards for grades. As I always say, if you control the unit of measure, you control everything. If you can change what constitutes a passing grade, you will have a higher passing rate without improving the education of a single student. 

The Voice of San Francisco reports, “Without seeking approval of the San Francisco Board of Education, Superintendent of Schools Maria Su plans to unveil a new Grading for Equity plan.” There is no input from anyone, just a top-down imposition. It’s how the party of “This is what democracy looks like” operates. 

What do you have to do to pass under this “plan”? The real question is, what do you have to do to fail, which is almost impossible to do? Getting 21 percent is the lowest “D” grade under it, not the 60 percent it used to be. A C grade can be gotten with as low as 41 percent, meaning you can get more wrong than right and still score an average. 

The whole damn thing is a mess and a disgrace. VoSF continues, “Grading for Equity eliminates homework or weekly tests from being counted in a student’s final semester grade. All that matters is how the student scores on a final examination, which can be taken multiple times. Students can be late turning in an assignment, showing up to class, or not showing up at all without affecting their academic grades. Currently, a student needs a 90 for an A and at least 61 for a D. Under the San Leandro Unified School District’s grading for equity system touted by the San Francisco Unified School District and its consultant, a student with a score as low as 80 can attain an A and as low as 21 can pass with a D.” 

How can a parent accept that? How can teachers live with themselves, knowing they will be passing and ultimately graduating kids who can’t read or do basic math as a matter of policy? 

Or course, liberals elect these people, repeatedly empowering them to screw people over. While the children of the wealthy will avoid this – this is starting in only 14 schools, mostly poor and low performing, so they can pretend they’ve raised grades by lowering standards – it will impact everyone. How do they live with themselves? 

The truth is it won’t impact them. They send their kids to good schools, often private schools, while they play games with the existence of poor kids because, well, because they can. What are the people of San Francisco going to do? Should they vote for Republicans? They’re not about to do that; they went to San Francisco public schools!

Globalism Gone Wild


I bet the vast majority of Americans, from both sides of the political aisle, would be appalled if they knew how globalist and authoritarian the European Union and most of its member countries have become in recent years.

Here is one vivid example of the authoritarian creep. Did you know that Europe is stifling free speech, especially via online platforms, in order to limit so-called hate speech? In November 2024, a 64-year-old German citizen was arrested for posting a picture of Deputy Chancellor Robert Habeck with the caption “professional idiot” on X.

According to a German newspaper, “The public prosecutor's office in Bamberg in northern Bavaria confirmed on Friday that the suspect's flat had been searched, with a tablet device being seized, and that the Green party's candidate for chancellor in upcoming elections had asked authorities to prosecute an alleged insult against him.”

This is not a one-off situation. It is happening across Europe, especially in the United Kingdom.

This is also not a new phenomenon; for centuries, major European powers were ruled by despots.

However, what makes the situation occurring now particularly alarming is that the European Union, through blunt, bullying tactics, is attempting to make other nations surrender their sovereignty in order to be able to conduct business within the European Union (EU).

The primary way the EU is seeking to reset global commerce is via the innocuous-sounding Corporate Sustainability Due Diligence Directive (CSDDD).

As my colleagues Justin Haskins and Jack McPherrin note in a recent Heartland Institute Policy Study outlining the CSDDD:

“It is not hyperbolic to say the CSDDD is one of the most economically restrictive and nakedly authoritarian laws in the history of western democratic civilization. The directive attempts to globally institutionalize sweeping ESG objectives by mandating practices for large companies doing business in the European Union, regardless of whether those companies are headquartered in the EU. Even worse, the CSDDD forces those companies to impose the same standards on many of the businesses operating within their global supply chains— fundamentally transforming all social and economic activity around the world. It is one of the gravest threats to freedom that Americans face today.”

In a nutshell, the CSDDD would force nearly all U.S. businesses, from giant corporations to small family farms, to play ball with the EU’s byzantine environmental regulations and woke social agenda.

Of course, this would impose a bureaucratic burden that would cause many small- and medium-sized businesses to shut down or be gobbled up by large corporations that have the means to satisfy the maze of paperwork the CSDDD would inflict.

Like the Great Reset, the brainchild of the super-authoritarian World Economic Forum, the CSDDD seeks to execute a new global order wherein European elites calls the shots.

Fortunately, the Great Reset became a worldwide punchline. It is now mocked and ridiculed as an egregious example of globalism gone wild.

Yet, it would be unwise to believe that European authoritarian globalism has been defeated because the Great Reset is a universal joke and the WEF is on its heels. It appears that the European elites have learned at least a little bit from their COVID-era overreach.

I believe the Europeans elites who seek to reorder the global economy realized that their messaging failed but so did their overall strategy.

Instead of using the WEF to “convince” the world, namely the United States, to go along with their globalist scheme, they have decided to leverage the sheer enormity of the EU economy to force other nations to get onboard the globalism train.

By flexing the muscle of the world’s second-largest economy, the EU believes it can force worldwide “participation.”

Suffice to say, this is a major gamble that could blow up worse than the failed launch of the Great Reset.

On the other hand, I have a sneaking suspicion that many large U.S. businesses would likely kowtow to the EU’s demands, lest they lose precious market share in Europe.

All of this is surely complicated by the ongoing trade negotiations that are currently taking place between EU leaders and Trump administration officials.

I hate to have to say this, but I wish our European friends would be more appreciative of everything the United States has done over the past century or so to protect their freedom. It is ironic that Europe, which we saved twice from the authoritarian abyss, now spreads authoritarian globalism.



If You Think the GOP Is Screwed Up, Check Out the Democrats


You may feel terrible about being a member of the Republican Party because it’s the stupidest party in American politics until you remember that the Democrat Party exists – and no, the Libertarian Party is not actually a party; it’s the motley crew of pot-addled sophomores holding forth in the dorm suite common area at 2 a.m. of American politics. For all the failures, foibles, and follies of the inept GOP, the current Democrat Party is much, much worse off. I mean, just look at them. They’re treading water in a swamp of narcissistic mediocrity, abandoned by former allies like the working class, controlled by over-credentialed echo-chamber neurotics, and in thrall to a coalition of sexually confused neo-Marxist weirdos, losers, and mutations.

You really gotta hand it to them – we couldn’t imagine a party more inept than the Republicans, but the Democrats have managed to prove us wrong. They’re coming off a disastrous last few years where they installed a human eggplant as their party leader, a president whose growing senility was built on a solid foundation of a half-century of being an idiot. This guy wrecked the economy, threw open the borders, and managed to get a bunch of Americans killed by some of the few remaining Third World savages that he hadn’t already invited into our country. Then, after four years of nonstop babbling about “Our Democracy,” the donkey politburo pulled his card following a disastrous debate where the best thing you could say about his performance was that he didn’t soil himself, at least as far as we know.

They replaced him with Kamala Harris, a woman of towering unaccomplishment who was so dumb that they wouldn’t even let her talk to the fawning media until they basically had to, at which point she demonstrated why they wouldn’t let her speak to the media in the first place. She blew her most important decision, selecting her running mate, by channeling Harvey Korman and not picking Josh Shapiro. Instead, she invited Tim Walz to prance out onto the national stage, purportedly because he could attract men, proving once again that context is everything.

The Democrat Party has become utterly feminized, its leadership a collection of Chardonnay-swilling, SSRI-gobbling, urbanized pinko crones – and that’s just the ones who identify as male. The allegedly female ones – let’s not even get started with the party’s bizarre trans obsession – are mostly middle-aged, naggy Karens with sour apple doll faces and the conviction that Gaia has instilled in them the duty to ensure that the manager hears about how America is misbehaving. The exception is the phony likes of Jasmine Crockett, whose transformation from articulate, educated young lady to finger-wagging, ghetto-fabulous stereotype is just plain embarrassing. It says a lot – and nothing good – that harpies like these run the Democrat Party.

Naturally, that repels anyone with descended testicles. The Democrats have now realized that they have a man problem, starting with the fact that they hate men – real men, the kind who like beer and guns and God and America. Like Hollywood is always trying to push glum, hefty shrews like Lena Dunham and Amy Schumer upon disgusted and appalled moviegoers, the Democrat Party seems obsessed with the idea of forcing flaccid phonies like Walz and Pete Buttigieg down our throats, thereby redefining manhood into something that has nothing to do with manhood. Just look at fey X influencer Harry Sisson; despite his fumbling online catfishing, he’s less a masculine role model than a sassy sidekick. They put David Hogg in as a DNC vice chair, at least for a little while, presumably to capture the loyalty of the key “males who yearn to be disarmed and neutered” demographic. As many men appeared at the polls to vote for “Shotgun Tim” Walz as Tim Walzes appeared for deployment. 

Stunningly, their femboy ploy has failed, and the Democrats remain utterly baffled by how to appeal to people with penises. Naturally, their bright idea is to throw money at the problem. They’re dunning the usual billionaires to pony up some cash to find themselves a comparable podcast voice to Joe Rogan and similar new media influencers, except you can’t buy authenticity. Cue visions of Steve Buscemi showing up to greet his fellow kids: “Young male-identifying persons, like you, I enjoy a hearty brew, video games, and sportsball.”

But it gets even better. According to the New York Times, the ace anthropologists of the Democrat Party have decided they need to perform an in-depth study of what makes men male and how to communicate with these backward primitives:

"The prospectus for one new $20 million effort, obtained by The Times, aims to reverse the erosion of Democrat support among young men, especially online. It is code-named SAM - short for 'Speaking with American Men: A Strategic Plan' - and promises investment to 'study the syntax, language and content that gains attention and virality in these spaces.' It recommends buying advertisements in video games, among other things."

They have tried this stuff before, with hilarious results. Say what you will about the Republican Party, but at least it’s not squandering its sweet, sweet cash on syntax studying – which is too bad because I totally would’ve taken its money and built that wine cellar I’ve been wanting. Oh well, I’ll give you the 411 for free, GOP: Don’t be sissies. 

Shhhh, do not share this valuable advice with the Democrats! 

Oh, go ahead. They won’t listen. In fact, their proposed solutions indicate that they don’t even understand the problem. They seek to find a lefty podcast superstar and “gain attention and virality” not to learn about what men actually want but to find better ways to tell men what to want. Here’s the challenge for the Democrats – they want to appeal to the people who their ideology has driven away without changing their ideology. They’re offering normals the same reeking dung as always, just polished up.

Have you ever heard a single Democrat explain which of their prized political positions they’re willing to compromise, much less abandon, in order to reach out to the people they’ve alienated? The voters they’ve lost didn’t wander away and head towards Trump because he’s shiny. They left because they don’t like the things the Democrats stand for. So, what do the Democrats propose to change to get them back? Are they going to moderate their jihad against babies? Are they going to keep naked dudes out of girls’ locker rooms? Are they going to start putting criminals in jail instead of back on the street? Will they quit trying to take our guns? Will they stop trying to steal our money to pay off the debts of blue-haired gender studies graduates? Will they cease their efforts to make us stop barbecuing and driving trucks in order to appease their angry weather goddess? Are they going to quit talking about how America sucks and how Americans are white nationalist racists of racism?

Of course not. Their offer is nothing. They’re not going to do any of these things because these are all sacred tenets in their secular pagan religion. To them, holding these stupid positions makes them good people. It’s what distinguishes them from the masses. To ask them to change is to ask them to give up their identity as well as the moral high ground, so their plan is to hector and pester more intensely so that normal people will submit. 

This brings us to the key difference between the current Republican Party and the current Democrat Party. It’s the difference between bottom-up and top-down evolution. The current Republican Party changed over the last 20 years in the direction that normal people wanted. The GOP base got sick of useless hacks like the Bushes and Mitt Romney, guys mostly concerned with gentlemanly managing decline and went with the guy who got the things they wanted done while owning the libs. But the Democrats did the exact opposite. The Democrat Party doesn’t want to be led by the voters; like all good communists, its leadership considers themselves the cadre who will lead the masses. The Democrats are finding out what happens when you give a revolution and nobody comes.

Fortunately for us, they can’t change direction anytime soon. They have dug themselves into a hole, and they’re still digging. We’ve seen it before. After their 1968 loss, the Democrats decided that the voters were wrong, and they should tack super-hard to the left. They were destroyed in 1972. After their 1980 loss, they decided the voters were wrong, and they should tack super-hard to the left. They were destroyed in 1984. After their 2024 loss, they will decide the voters are wrong and that they should tack super-hard to the left once again. They will convince themselves that it’s a great idea to nominate AOC or Buttigieg or some other spazzy clown who is extremely popular in Manhattan’s Upper West Side, Scat Francisco, and the Harvard faculty lounge (if there’s anything left of it when Trump gets finished with it) but who repels and disgusts normal people. They will get destroyed in 2028.

And you know what? Good. Because the only way a party as stupid as the current establishment Republican Party can win is if it’s competing against a party as stupid as the current Democrat Party.

FBI Director Kash Patel Gives Interview on Fox News to Instill Confidence in FBI Mission


Two days ago, Deputy FBI Director Dan Bongino sought to address frustration by promising things in the background were taking place and that is why both he and Director Kash Patel were not making media appearances.

Tonight, FBI Director Kash Patel appears on Fox News to affirm confidence in the FBI.  Tomorrow Deputy Director Dan Bongino will appear on Fox and Friends to do the same.

Director Patel rejects the notion that the FBI is institutionally corrupt and fraught with malicious actors.  Director Patel says he has been sharing information from the FBI silo with “partners in congress” and more information is going to be released. The extensive interview is in two segments, presented below:





Here’s What The ‘Big Beautiful Bill’ Says About Suppressors


‘Even if it passed exactly as it did in the House, it would represent, likely, the most important victory for the Second Amendment community in the federal legislature in at least 20 years.’



Since the National Firearms Act was passed in 1934, suppressors, which are a popular hearing protection device used by law-abiding gun owners, have been subject to burdensome registration regulations and a hefty tax price tag that some say infringes on the Second Amendment. The House of Representatives’ version of the Big Beautiful Bill, however, could change that.

Republicans in the lower chamber sought to effectively deregulate the noise muffling device by adding a Reduction of Excise Tax on Firearms Silencers section to their reconciliation legislation. Demand for suppressors has nearly doubled in recent years.

The fate of the bill, which also declares that “there shall be levied, collected, and paid on firearms transferred a tax at the rate of $0 for each firearm transferred in the case of a silencer,” remains unknown until the Senate takes up the Big Beautiful Bill, but could prove historic if it manages to pass the upper chamber.

“Even if it passed exactly as it did in the House, it would represent, likely, the most important victory for the Second Amendment community in the federal legislature in at least 20 years, you could argue in the last 40 years, you could argue ever, because gun control legislation has tended to be a one-way ratchet,” American Suppressor Association General Counsel Michael Williams told The Federalist.

Suppressors would still be subject to the 4473 paperwork and NICS background check required for any firearm purchase from a federally licensed firearm dealer, because they are still classified as firearms under the Gun Control Act.

Those who are cleared to purchase them, however, will no longer have to undergo the cumbersome process of submitting fingerprints, a photo, and Form 4 to the U.S. Bureau of Alcohol, Tobacco, and Firearms (ATF), in addition to paying the $200 tax stamp required to leave a gun store with the hearing protection device.

Currently, most buyers find that it takes around 10 days to clear that red tape, but the ATF warns that it could take closer to two months. Once buyers secure their suppressor, they must keep their approval form and tax stamp with it to provide proof of ownership.

A last-minute amendment inspired by section two of the Hearing Protection Act also guaranteed that suppressors will be declassified as a type of “firearm” that requires addition to the National Firearms Registry.

According to Williams, this amendment would “just remove them from the NFA entirely. And in case that doesn’t work, the backup is included there, which is pulling the tax down to $0 and then keeping that Form 4 a National Firearms Act process.”

Democrats often invoke suppressors when pushing to enact Second Amendment-infringing gun control.

“Silencers make mass shootings worse, more deadly,” Democrat Rep. Gabe Amo of Rhode Island claimed. “They make it harder for victims and law enforcement to locate the source of the shooting. What is beautiful about that?”

The U.S. Concealed Carry Association notes, however, that “silencers are so rarely used in violent crimes that it is hard to find meaningful statistics on them.” As of 2017, more than 1.3 million Americans were clocked as owning suppressors. Yet only about 0.003 percent of those suppressors were used in violent crimes.

Most people purchasing suppressors do so with the intent of reducing the decibel damage gunshots can have on human hearing. Calling the muffling cans that attach to firearm barrels “silencers” often leads people to believe that they cancel out all of the noise associated with a trigger pull. While suppressors don’t entirely dampen the loudness of gunshots, they do reduce the sound by 20-35 decibels. Even with a suppressor, gunshots can range anywhere from 110-150 decibels, the equivalent of anything from a jackhammer to a jet takeoff.



'It's Hopeless': Crestfallen CBS Hack Lesley Stahl Doesn't 'See a Path Out' of Trump's America

The veteran CBS News reporter not only doesn't see a way out of the horrors visited upon America by President Donald Trump; she's also "kind of down" as a result.

Please.

The CBS "60 Minutes" correspondent appears in a fearmongering PBS special, titled "How Much Executive Power Is Too Much? Breaking the Deadlock: A Power Play,which masquerades as an in-depth look at the executive powers of the presidency.

Yes, gang — without reading another word, you can already tell that the dumpster-fire special is simply another hit piece on Trump in which he's portrayed as a threat to democracy.

Did I mention that Trump is hypothetically portrayed by fictional "President Powerton?" Yeah. More of your tax dollars "at work," my fellow freedom-loving Americans.

As reported by NewsBusters, after the ridiculous hit job leads viewers to a foregone conclusion that Americans should fear and reject drunk-with-power "President Powerton,” moderator Aaron Tang asks Stahl and the other panelists:

One last question: folks, is there any reason for hope?

Seriously? What — as if Lesley Stahl was going to enthusiastically answer: "Why sure there is! President Trump is not only a great American, he deeply cares about all Americans! You'll see!" 

Again, please.

Here's how Stahl actually responded:

I am not hopeful. I look at all our institutions, all of which have lost the respect of the American people. I worry about the future of democracy, obviously. And, I don't see a path out. So, I'm kind of down.

Oh, horse pucky.

With due [ahem] respect, out-of-touch-with-reality Stahl is neither worried about the future of democracy nor is she "down."

Lemme rephrase that: If Stahl is down, what she's down about is Trump's continuing successes in direct contrast with the current state of the radicalized, TDS-riddled Democrat Party.

At another point in the program, Stahl spewed: “America is crumbling because of this president.” 

Raise your hand if you think Ms. Stahl provides a single example or a shred of evidence to back her hyperbolically nonsensical claim. Of course she didn't — just like she didn't present an example of a single institution losing the respect of the American people under Trump.

On the contrary, Ms. Stahl, American institution after American institution has regained the respect of the American people after four disastrous years of the Biden-Harris administration. 

From the U.S. Armed Services to the CBP (Customs and Border Patrol) to the FBI and the U.S. State Department, patriotic Americans are once again proud of our institutions — and the direction the country is headed under President Trump.

Oh, I almost forgot: arrogant-to-the-max Rep. Dan Goldman (D-NY), also a panelist, declared: 

The president thinks every single thing he does is justified, just because he won an election – he’s wrong.

Goldman is a former assistant U.S. attorney who led the first clown-car impeachment of Trump.

While the silly program claims to examine the limits of presidential authority, it instead presents a hypothetical series of events in which Trump surrogate “President Powerton” attempts to defy a Supreme Court ruling striking down one of his executive orders:

  1. President Powerton issues an executive order canceling a “green,” farm grant, without which farmers will go bankrupt and lose their farms.
  2. A state attorney general sues the president, challenging Pres. Powerton’s authority to cancel the grant.
  3. A court rules Pres. Powerton can’t cancel the grant checks – so the president tries to bribe a member of his administration to stop the payments, anyway.
  4. The Supreme Court strikes down Pres. Powerton’s executive order when he appeals the decision.
  5. Pres. Powerton looks to defy the Supreme Court’s ruling.
  6. Powerton orders the U.S. attorney general to find dirt on the state attorney general who sued him, then fires the AG when he refuses to prosecute.
  7. When the state attorney wins a Senate seat, a Powerton supporter tries to kill him, gravely injuring the senator-elect.
  8. After the would-be assassin is convicted of felony assault, Pres. Powerton decides to pardon him, despite being advised not to, by members of his administration.

Truly sad. 

Sophomoric, for sure — but also sad that even PBS would stoop to such a pathetic low. Moreover, the thinly veiled shot at Trump clearly demonstrates how the taxpayer-supported "news" outlet sees its snooty yet intentionally low-information viewers. 

Hilarious for sure, but sad, just the same.



DHS Says Illegal Alien Arrested for Threatening to Assassinate Trump

Fox's Bill Melugin is reporting that the Department of Homeland Security (DHS) and Immigration and Customs Enforcement (ICE) have arrested a Mexican illegal alien in Wisconsin who allegedly threatened to assassinate President Donald Trump by shooting him in the head. 

According to the allegations from DHS: 

54-year-old Ramon Morales Reyes mailed a handwritten letter to an ICE agent on May 21st, expressing anger at deportations of family members, and allegedly claiming he would use his gun to shoot Trump at a rally. 

ICE arrested him the next day, last Thursday. 

DHS says Reyes illegally re-entered the US at least 9 times between 1998-2005, and has criminal convictions for felony hit and run, criminal damage to property, & disorderly conduct w/ domestic abuse.

 He remains in custody in Juneau, WI.

DHS Secretary Kristi Noem issued a statement praising the work of the ICE agents involved. She said this came less than a year after the attempt on Trump's life in Butler, and less than two weeks after former FBI Director James Comey made his "86 47" post, which Noem said "called for his [Trump's] assassination." She called on all politicians and those in the media to take note of these incidents and "to tone down their rhetoric." She added that she would take all measures necessary to protect Trump. 

It's probably not a wise move to allegedly send a threat to an ICE agent. And he's upset about deportations while he's allegedly here illegally himself, repeatedly? That takes a lot of gall. I don't think he has much to complain about if this is true. 

The Democrats should calm down their rhetoric, as Secretary Noem says. Instead, they seem to be ratcheting it up, painting normal ICE actions as somehow evil and out of the norm, and of course, always whipping people up against President Donald Trump and painting him as a fascist, as though ICE was only started under him to oppress people instead of to protect us and the rule of law.  

Can we count on Democrats and their fellow travelers now to rush to this man's side and find some reason to embrace him? I wouldn't put it past them. We've seen a lot of bad takes when it comes to illegal immigration. 

Democrats keep being more extreme on the issue. It was one of the main reasons voters went for Trump in November - because they wanted a lot more done about border security and they're supportive of deporting illegal aliens. If they're going to get back voters, Democrats are going to have to change from their failed approach. But Democrats don't seem to grasp that and just seem to ignore that fact.



Federal Trade Court Rules President Trump Cannot Initiate Tariffs Under International Emergency Economic Powers Act, All Tariffs Blocked

UPDATES AT BOTTOM: A federal trade court based out of New York has just ruled in a three-judge decision that President Trump does not have the authority within the International Emergency Economic Powers Act (IEEPA) to initiate emergency trade tariffs.  [The Ruling is HERE]

WASHINGTON DC – A federal trade court ruled President Trump didn’t have the authority to impose sweeping tariffs on virtually every nation, voiding the levies that have sparked a global trade war and threatened to upend the world economy.

The decision on Wednesday from the Court of International Trade blocked one of the Trump administration’s most audacious assertions of executive power, under the International Emergency Economic Powers Act of 1977, and sets the stage for a possible appeal by the White House.

“The court does not read IEEPA to confer such unbounded authority and sets aside the challenged tariffs imposed thereunder,” a three-judge panel wrote. (link)

“The Worldwide and Retaliatory Tariff Orders exceed any authority granted to the President by IEEPA to regulate importation by means of tariffs,” the court wrote.  The court also ordered that the tariffs that the Trump administration has collected so far be “vacated.”

UPDATE #1: I’m tearing through this ruling right now and I can find several structural flaws in the 3-judge panel decision.

[From Page 6, pdf] “…[…] in 1962, Congress delegated to the President the power to take action to adjust imports when the Secretary of Commerce finds that an “article is being imported into the United States in such quantities or under such circumstances as to threaten to impair the national security.” Trade Expansion Act of 1962, Pub. L. No. 87-794, § 232(b), 76 Stat. 872, 877 (codified as amended at 19 U.S.C. § 1862(c)(1)(A)). This delegation is conditioned upon an investigation and findings by the Secretary of Commerce, and agreement by the President. See id. Section 301 of the Trade Act of 1974, as amended, requires that the U.S. Trade Representative (“USTR”) take action, which may include imposing tariffs, where “the rights of the United States under any trade agreement are being denied” or “an act, policy, or practice of a foreign country” is “unjustifiable and burdens or restricts United States commerce.” 19 U.S.C. § 2411(a)(1)(A)–(B). The USTR may impose duties also where the USTR determines that “an act, policy, or practice of a foreign country is unreasonable or discriminatory and burdens or restricts United States commerce.” Id. § 2411(b)(1). This power is conditioned on extensive procedural requirements including an investigation that culminates in an affirmative finding that another country imposed unfair trade barriers under § 2411(a)(1)(A) or (B) or § 2411(b), and a public notice and comment period. I’ve just gotten started, but that citation is just one reason why the ruling can be overturned on appeal.

The Sec 301/302 investigation and process noted above was completed by USTR Jamieson Greer, with extensive citation.  USTR Greer published a 397-page investigative outcome detailing the “unreasonable and discriminatory” burdens to United States commerce. [SEE HERE pdf]

The New York trade court literally ignored the 2025 USTR investigation, AND the 2025 Dept of Commerce review and investigation of the same based on the USTR published findings.  All of those factual investigative findings underpin the Presidential actions taken pursuant to his authority under the International Emergency Economic Powers Act.

It looks like the trade court didn’t even review the USTR reports.
