Lady Justice Loses Her Blindfold

Agenda-driven judges and advocacy from the bench are the last thing we need as we drift further away from rule of law that has always been one of the pillars of America’s greatness.

Traditionally, one of the reasons people around the world have tried to relocate to America over other locations has been our enlightened justice system. Unlike some other countries, America has been a place where even those of modest means and lower social standing can at least get their day in court.

Vital to that system is that judges go through rigorous legal training, swear to uphold the law, and act with impartiality when making decisions in the courtroom. Should judges take on the role of advocates, the integrity of the justice system begins to crumble.

We have now reached that undesirable place, as judges apparently can refuse to uphold the law, act as advocates for one side, and face no consequences as a result.

That is the inescapable conclusion after Newton (Massachusetts) District Judge Shelley Joseph recently had her suspension dropped after being accused of helping an illegal alien evade an Immigration and Customs Enforcement (ICE) agent who was waiting to carry out a federal arrest he had every legal authority to make.

The sordid tale of Judge Joseph should be a warning sign that something is amiss in our justice system. While hearing the case of Jose Medina-Perez in 2018, Joseph asked an ICE officer to leave the courtroom and wait in the lobby outside. With the ICE officer waiting out of the courtroom, Joseph held a sidebar conference with the assistant district attorney and Medina-Perez’s attorney.

After Joseph instructed the clerk to switch off the courtroom recorder for 52 seconds—in violation of Massachusetts courtroom rules—court officer Wesley MacGregor led Medina-Perez out the courthouse’s rear exit. While the ICE officer waited patiently nearby, Medina-Perez escaped deportation with the assistance of three sworn officers of the court: the judge, the prosecutor, and the defense attorney—all of whom swore an oath to “do no falsehood, nor consent to the doing of any in court.”

The result was outrage at ICE headquarters in Washington, D.C., and in much of the law enforcement community. Joseph was hit with federal charges of conspiracy and obstruction of justice. The U.S. attorney handling the case described Joseph’s actions as “clearly criminal,” and even groups sympathetic to her case were hesitant to defend her.

“There are elements of this that have a very bad look,” said Ivan Espinoza-Madrigal of Lawyers for Civil Rights, which has filed a lawsuit to block ICE courthouse detentions. “I wouldn’t defend turning off the recorder in the courtroom.”

Despite Joseph’s apparent guilt, she is free of charges and likely to return to the bench. Why? With the inauguration of Joe Biden in 2021 came new U.S. attorneys, one of whom chose to drop the case against Joseph. With the Biden Administration unlawfully eliminating virtually all consequences for violating the Immigration and Nationality Act, the last thing it would do is prosecute a judge who launched a criminal conspiracy to hide a foreign national, clearly in violation of our immigration laws, from an ICE agent.

Whatever excuse the Biden Justice Department offers, there is a strong legal argument for Joseph’s prosecution. 8 U.S.C. Section 1324 says that “any person who, knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals, harbors or shields form detection, or attempts to harbor, or shield form detection, such alien in any place, including any building or any means of transportation,” is subject to a fine and/or up to five years in prison.

A state court judge is not exempt from this law, and by the supremacy clause of the 10th Amendment has no authority to impede, prohibit or otherwise interfere with an ICE officer engaged in the lawful performance of his duties.

Red flags as to Joseph’s fitness as a judge were present at her nomination hearings in 2017. There, she spoke of her mother teaching her “to be an advocate.” That is a great philosophy for a defense attorney, but a horrible one for a judge from whom objectivity is both expected and required.

And for whom was Joseph such a passionate advocate? Medina-Perez, a native of the Dominican Republic, had been arrested in Newton on narcotics charges and had been linked to a drunken driving warrant in Pennsylvania. He had been deported twice from the United States and had been prohibited from entering the country for 20 years, according to the federal indictment. Thanks to Joseph’s advocacy, a menace to society was released into a U.S. community, rather than facing the deportation he deserves.

If Joseph’s brand of adjudication is to be the new normal, then our justice system and America itself is truly in serious trouble. Agenda-driven judges and advocacy from the bench are the last thing we need as we drift further away from rule of law that has always been one of the pillars of America’s greatness. What is even scarier is that we are retreating from our own legal standards even as we fill our country with people who began their relationship with the United States by breaking our laws.

X22, On the Fringe, and more- Nov 24 🍗

Hope you all a fantastic day! I woke up, and found this nice surprise from TV Line's 'What our Readers are thankful for this year' yearly list:

2nd year in a row that I've been included! (last year was for mentioning Hetty and Nell's hug at the end of Season 12). Then I read a book, had ice cream, watched a couple episodes of a good show on my laptop, and just had the biggest dinner I can ever remember having on this day! (usually I just have a bit of the ham and baked potatoes, not a 4 course meal!). So yeah, today has been awesome! And I'm also pleased to see so much civility on this site for a change! It's nice to know that patriots and name calling trolls alike can mostly try to act peaceful on an important holiday.

Here's tonight's news:

Biden’s Bullet Points

On the home front under the Delaware Democrat,
tanks may roll, bullets fly, and bodies fall.

“Every tyranny must decide whether to rule by brutal force or by persuasion,” contended Josiah Lippincott on November 5. “Brute force isn’t an option for the modern Left. They lack the Soviet talent for mass scale political violence. Vladimir Lenin had legions of men like Yakov Yurovsky, the killer who butchered the Russian czar and his entire family, at his disposal. Does Joe Biden?”

Good question. The answer might start with the Federal Bureau of Investigation.

Back in 1992, the FBI’s sting operation on Randy Weaver turned deadly for Weaver’s son and a U.S. Marshal. The FBI then deployed some 400 heavily armed agents, helicopters and armored personnel carriers against a single family. The rules of engagement allowed deadly force against any family member seen with a firearm, but in effect the policy was to shoot on sight.

FBI sniper Lon Horiuchi shot Vicki Weaver in the head as she held her infant daughter. She had committed no crime and there was no warrant for her arrest. Snipers are trained carefully to “acquire” their targets, so the chances the killing of Vicki Weaver was accidental, as FBI bosses claimed, range between slim and none. The following year, the FBI-military axis mounted a surge.

“A host of Patton tanks were part of an arsenal of military hardware that the FBI used against the Davidians during the 51-day siege that killed 84 people,” reported Robert Bryce of the Austin Chronicle.

The Patton tank, a combat engineer vehicle (CEV) stands 10 feet tall, spans 12 feet wide, weighs more than 120,000 pounds, and was designed to fight the Soviet Union. As it emerged in court testimony, the FBI had at its disposal five Patton tanks, 10 M2 Bradley Fighting Vehicles, one M88 tank retriever, and one M1A1 Abrams tank, as Bryce notes, “the most sophisticated battle tank ever built.”

The use of the tanks, “was just one facet of a massive armored invasion of the Branch Davidian site. During the siege, the distinction between police and military all but disappeared.” The Waco assault was “the bloodiest and most controversial police action in American history.”

In 1993, same year as Waco, the FBI failed to stop the first attack on the World Trade Center. Assigned to prevent terrorism, the FBI also failed to stop the massive attack of September 11, 2001. The FBI knew all about “soldier of Allah,” Major Nidal Hasan, but failed to stop his murder spree at Fort Hood in 2009.

In similar style, the FBI failed to stop deadly attacks on the Boston Marathon (2013), San Bernardino County government workers (2015), and revelers at an Orlando nightclub (2016) before actual domestic terrorists slaughtered scores of innocent Americans. While failing at its appointed tasks, the FBI mounted covert operations against candidate and then President Donald Trump, and not a single FBI boss has faced criminal charges.

The FBI now echoes Joe Biden’s view that anyone less than worshipful of the Delaware Democrat is a domestic terrorist, militant extremist, and so forth. Biden adds “semi-fascist,” and “Ultra MAGA,” to the mix. When people call you names like that, they are laying the groundwork for repression and violence.

Biden’s September 1 hate speech, backdropped in red, featured two U.S. Marines in the background. For all but the willfully blind, this was a clear threat of military action against the people. Recall that 26,000 National Guard troops walled off Biden’s inauguration and 7,000 remained in Washington until the end of January. The National Guard has a history that people of a certain age may remember.

In early May 1970, during protests of the war in Vietnam, nearly 1,000 National Guard troops occupied the campus of Kent State University, making it appear like a military war zone. Ohio Governor James Rhode called the protesters the worst kind of people in America, and said that every force of law would be used against them.

On May 4, 1970, National Guard troops fired into a group of Kent State anti-war demonstrators, killing four students and wounding nine others. A bullet struck Jeffrey Miller, 20, in the mouth. Allison Krause, 19, took a shot in her left side.William Shroeder, 19 took a bullet in the left side of his back and Sandra Scheuer, 20, a speech and hearing therapy major, took a fatal bullet in the neck.

National Guard troops shot Dean Kahler in the small of his back, leaving the student paralyzed from the waist down. Eight others were wounded, including Donald MacKenzie, struck in the neck. This is what happens when politicians turn a college campus into a war zone.

The Biden junta can also count on the forces of Antifa, BLM, and freelance criminals, willing to burn, loot, and murder. For Biden, Antifa was only an “idea,” not a militia, extremist group, or domestic terrorist organization. During the worst of the violence, the FBI looked the other way, and now deploys massive force and military weapons while arresting peaceful pro-life protesters

According The Black Book of Communism, the Chinese Communist regime murdered more than 60 million people, the most domestic casualties of any nation, and far surpassing Joseph Stalin’s Soviet Union. Biden believes the Chinese Communists are “not bad folks,” and the Delaware Democrat sees the greatest threat from those who want to make America great again.

This demented misanthrope has the forces for mass political violence at his disposal. As Americans protest his destructive policies, don’t be surprised if the tanks roll, the bullets fly, and the bodies fall.

Reminder, Watch Inside RNC Club Rule Changes and 2024 Moves Next Month

In the background of the Republican dynamic, CTH has been reminding everyone about the nature of the Republican National Committee (RNC) and Democrat National Committee (DNC) being private clubs, private corporations, unaffiliated with government.  Most casual voters do not understand what this key and important distinction means within U.S. elections.

There are two private corporations representing Republicans and Democrats; they are most commonly referred to as political parties. There is no basis for the existence of private political parties in the United States constitution.  Both parties function from a position as private interests outside the framework of government.

What we commonly refer to as ‘politicians’ are selected representatives to the government from each of the corporations.  What we commonly refer to as ‘primary elections’ are suggestions to each of the corporations from citizens expressing their preference for the representative.   The corporation can individually choose to accept or decline the suggestion from the voters, and the only thing that binds the corporation to follow the suggestion are the corporate rules.

The corporation of the RNC and DNC exist to serve their own interests.  Politics is the RNC and DNC business; however, the income stream -the financial aspects to the business- is what holds influence over the corporate priority.  Ideology is part of the equation, but control of the business and generating revenue is the main function of the corporation. Unfortunately, in the reality of the business model, election outcomes are downstream from those two priorities.

It is with this corporate baseline in mind that all ‘primary election’ political analysis should take place.  The economics of the thing is what Republican officers in the RNC emphasize.  Without money, the corporate mission doesn’t operate.  Without money the RNC members -essentially board members- do not function, hold meetings, assemble, or participate in the organization.  Therefore, from the standpoint of the corporation, the business of politics (inputs) drives the activity, not election results (outputs).

This facet to U.S. politics is rarely discussed because the corporations and the people who run them do not want this process emphasized.  However, if voters do not comprehend this dynamic, they can fall victim to the fallacy of false representative choice.

The corporation is made up of members.  The members make the rules.  The members have preferences and ideological outlooks about the objective of the corporation as part of their position within it.  Inside this dynamic is where you see the changing of rules to benefit the preferences of the members; ultimately influencing outcomes.

Unlike most political sites, CTH watches this inside club dynamic closely, because ultimately it explains a lot of ‘consequences’ that we see later discussed.  It is easier to just sit back and discuss the consequences than it is to watch the officials inside the club make rule changes proactively.  However, it is by watching the rule changes that we can see the roadmaps of influence within game as played by both RNC and DNC corporations.

Any political commentary that does not take this private club dynamic into consideration, and/or explain the consequences from decisions within the club, is not serving the interests of the American electorate.

The winter meeting of the RNC is taking place January 25-27th, in Dana Point California at the Waldorf Astoria – Monarch Beach Resort.  There are 168 members who will be in attendance (3 from every state) along with various RNC and national republican leadership.

This RNC corporate meeting, and the votes by the members, will determine the Republican Club rules for the 2024 election cycle.  Rules on primary dates, sequence, apportionment of delegates, distribution of delegates, state sequencing, qualifications and much more will be decided.

Rules that govern the candidates and campaigns of those who choose to run on the corporate identity of “Republican” will also be determined. Rules on financial agreements, expectations for data sharing, fundraising, contribution expectations (both directions) and much more will be determined.

It is inside this dynamic where one of the key club control battles is likely to take place.  It’s mostly boring and seemingly parliamentary stuff {Example Here}, but it has massive ramifications.

Some RNC members support MAGA, some do not.  Some RNC members support the Wall Street alignment, some do not.  Some members support the populist movement, others do not.  Some RNC members support a big tent approach to a working-class coalition, other RNC members regard the working-class as beneath their representative interests. The key point is that it’s a private club making these decisions.

The majority decision from within the club membership vote will determine each outcome(s).  Donald Trump may have earned 100 million voters and supporters, but only 168 unelected members and party officials will determine what that means to their corporate agenda.

There is no guarantee the America-First agenda of Donald Trump is in alignment with the 2023 priorities of the club.  Factually, all recent suggestions from the club control officers, the billionaire Wall Street donors like Ken Griffin, all suggest the removal of Trump and the MAGA agenda from association with the RNC Club should be the priority of the assembly.  The dynamic of financial influence, income to the corporation, changes the entire mechanism of the outcome.

As noted by ‘Niagara Frontier‘: “I’m watching for last-minute RNC rule changes for the national primaries and the selection of convention delegates. If we start hearing anybody, anywhere float a proposal in favor of Republican super delegates for the national convention, it’s total war.”

Niagara is absolutely correct.  The internal battle deep inside the club, fraught with influence, power dynamics and cliques positioning for control, is the part of the political dynamic that everyone should be watching closely.

We will be….

Rapper Ice Cube Refuses mRNA Vax, Loses out on a Cool $9 Million Movie Deal

 Bob Hoge reporting for RedState

Rapper/Actor Ice Cube lost out on a $9 million movie deal because he refused to get vaccinated for COVID, and he’s not happy about it. Ironically, the film he was axed from was called, “Oh Hell No.” You can’t make this stuff up.

Mr. Cube (may I call him that?) vented his frustrations on the podcast Million Dollaz Worth of Game:

Again, apologies for the profanity, but he says in the above clip:

I turned down a movie because I didn’t want to get the motherfucking jab. I turned down $9 million. I didn’t want get the jab. Fuck that jab. Fuck ya’ll for trying to make me get it.

Variety reports that the showdown occurred last year:

Reports surfaced in Oct. 2021 that Cube was dropped from Sony’s comedy “Oh Hell No,” directed by “Bad Trip” filmmaker Kitao Sakurai and co-starring Jack Black. Producers on the film reportedly requested all cast members be vaccinated in order to participate in the production, which at the time was planning to shoot in Hawaii during the winter.

Unlike some celebrities and athletes who have turned down the vaccination and discussed their decisions in measured tones, Cube holds nothing back as he tells us what transpired:Later in the interview, Cube clarified that he “didn’t turn down” a movie because of his refusal to get the COVID shot, adding, “Those motherfuckers didn’t give it to me because I wouldn’t get the shot. I didn’t turn it down. They just wouldn’t give it to me. The covid shot, the jab…I didn’t need it. I didn’t catch that shit at all. Nothing. Fuck them. I didn’t need that shit.”

Whoa. Tell us how you really feel.

Ice Cube isn’t the only one to lose out on millions for refusing the mRNA vaccines—Brooklyn Nets star guard Kyrie Irving lost a reported $11.4 million when he was not allowed to play at his home arena due to his COVID vaccine status. He missed 29 games over his refusal to bend the knee. Meanwhile, thousands of teachers, firefighters, police, health care workers, military personnel and others lost their jobs for declining the shots. While their losses might not be in the millions of dollars, their lives were certainly negatively impacted (understatement of the year).

Interestingly, my colleague Bonchie just published an article showing that more vaccinated people than unvaccinated are dying with COVID right now:

For the first time, a majority of Americans dying from the coronavirus received at least the primary series of the vaccine.

Fifty-eight percent of coronavirus deaths in August were people who were vaccinated or boosted, according to an analysis conducted for The Health 202 by Cynthia Cox, vice president at the Kaiser Family Foundation.

Dr. Fauci is finally gone, thankfully, but took the opportunity at his final press conference Tuesday to continue to call for more and more boosters. The vaccines have quite simply been a failure, and yet there are many in government and industry who continue to act like drug dealers in aggressively hawking the jabs.

Ice Cube might swear a lot, but I’ve sworn a lot during this madness myself.

I’m Thankful This Year For Everyone Fighting Against Transing The Kids

A gender “non-binary” lunatic shot up a gay safe space (otherwise known as a nightclub) so apparently anyone who ever thought it inappropriate for children to attend sexed-up drag shows is supposed to repent.

How about: No.

The success of the year has been making the weird and kinky things that liberals are doing with the nation’s children a fundamental political issue across the country. When moms and dads found out their kids were being trained in public school on how to hate white people and the ins and outs of transgenderism, they rose up to tell the taxpayer-funded public schools in unison: Knock it off, right now.

Elected leaders such as Govs. Ron DeSantis and Glenn Youngkin became heroes in no small part because they confronted the crisis by enacting policies explicitly banning the sick indoctrination of children. But they couldn’t have done it without influential voices on the right such as Tucker Carlson, the Libs of TikTok angel, and activist Christopher Rufo.

Immediately after last weekend’s deadly shooting at a gay nightclub in Colorado Springs, leftists and cable news anchors at CNN and MSNBC began pointing the finger at Carlson, declaring him responsible for the five dead bodies. After all, Carlson has been an outspoken opponent of sexualizing minors by way of adults living out their sex kinks in public schools and entertainment content aimed at children.

The prolific Libs of TikTok account was suspended on Twitter for republishing the videos and pictures that liberals had recorded of themselves confessing their methods in exposing minors to “queer” and transgender ideology.

And Rufo has been deemed an enemy of the state by the Anti-Defamation League, the Southern Poverty Law Center, and every other scam “anti-hate” group, because Rufo did dangerous things like blow the lid off of Disney executives detailing their intent on inserting “queer” material in films aimed at children.

The anti-groomer movement keeps going anyway. And for that, I’m thankful.

6 Hot-Button Topics To Help Spice Up Your Family’s Thanksgiving Dinner Conversation

The Federalist is here to help add some flavor to your family’s Thanksgiving dinner conversation by giving you the latest, hot-button topics to discuss at the table.

In America, there is no better way to kick off the “Most Wonderful Time of the Year” than with Thanksgiving. Filled with food, football, and family, the time-honored tradition of spending time with loved ones while stuffing our faces with turkey makes it a holiday unlike any other.

And while many Americans have grown to cherish such a day, others are stressed out. For the latter, the Thanksgiving feast is just another opportunity to get caught up in those awkward moments when a family member brings up the latest controversial issue in the news cycle. Before you know it, parents are bickering with grandparents, the dog is crying, and that toasty apple pie sitting on the counter ends up going cold.

Seriously, we’ve all been there.

But let’s say this year, your family dinner is a total snooze-fest. So boring, in fact, that the dead turkey sitting on your table picks itself up and leaves.

If you find yourself in such a situation, fear not, for The Federalist is here to help by giving you the latest, hot-button topics to add some flavor to your family’s Thanksgiving dinner conversation.

1. Donald Trump

What better way to add a little pumpkin spice to your family’s Thanksgiving than by bringing up the Orange Man himself? Unlike Joe Biden, who will probably be asleep by the time your family starts eating, Trump comes with a variety of sub-categories ripe for discussion.

Whether it be his tweets and Truths, 2024 candidacy, or covfefe, the Donald is a subject that can revitalize any dull Thanksgiving meal. Plus, if you wear your red MAGA hat, there’s a good chance your uber-liberal aunt will start hurling some pretty gnarly accusations that are bound to stir up a good debate.

2. The 2020 Election

If you aren’t preparing to bring along your copy of Federalist Editor-in-Chief Mollie Hemingway’s best-selling book, “Rigged: How the Media, Big Tech, and the Democrats Seized Our Elections,” to your family’s Thanksgiving Day festivities, then chances are you aren’t doing Thanksgiving right.

While this topic may seem too similar to Trump, the 2020 presidential election comes with its own unique features to help turn up the heat at your family’s Turkey Day. With Big Tech interference, incredibly dishonest media coverage, and an influx of private money to change election operations in states around the country, the 2020 contest presented a bevy of problems you can reference to better inform your relatives of the race’s many issues and shut down those dumb, “election denier” smears.

3. Men Competing in Women’s Sports

Tired of hearing about Uncle Bill’s uneventful life at the office? Then it might be worth your while to bring up the unjust nature of men “identifying” as females competing in women’s sports. That is, assuming that William — I mean, Lia — Thomas isn’t invited to your family’s Thanksgiving.

Caution is advised, however, if you have any relatives in attendance who dye their hair blue, put their pronouns in their social media bios, and still have their “I’m with Her” bumper stickers on their electric cars. At that point, you’ll probably need some earplugs to protect your eardrums against the screeching.

4. The War in Ukraine

While you’d be hard-pressed to find many people who support Russia’s invasion of Ukraine, the real topic of discussion over the ongoing war is what the U.S. response should be.

Should we send little Timmy to fight in another seemingly endless war? Do we keep writing a blank check to Ukraine for every “y” in Zelensky’s name? And what happens if Russia really does attack a NATO ally?

Much like Biden at a public event, the direction of this conversation could wander off in any direction.

5. Face Masks and Covid Shots

What better opportunity to break Cousin Kevin free from the “Covid cult” than at Thanksgiving dinner? Sure, he may keep six feet away from you since you opted not to get that experimental jab that doesn’t stop viral transmission, but that shouldn’t keep you from trying.

While it may be difficult to hear him through his masking in between bites, saving someone from the clutches of the “masks and jabs forevs!” crowd is one of the best gifts you can give this holiday season.

6. Abortion

Since the U.S. Supreme Court overturned Roe v. Wade earlier this year, abortion has been one of the hottest issues in America. Although it may be fun to mock Democrats’ insanity on the issue, this Thanksgiving may allow you to convey to some of your more lefty relatives the physical, mental, and emotional horrors of abortion.

Yes, it’s a topic bound to cause some friction. But the overall benefit of helping advance the cause of protecting innocent life is absolutely worth it.

10 Ways To OWN Your Conservative Relatives At Thanksgiving This Year

Article Image

Your family may say they want you over for Thanksgiving because they love you, but it's obviously a trap. They're going to ambush you with alternative facts that make Biden look bad. Get the drop on your dumb conservative uncle by coming to the table armed with facts and your truth that will absolutely destroy all who think differently.

Here are the best ways to own your conservative relatives:

  1. Say a toast for the indigenous land acknowledgment: Amen.
  2. Volunteer to say grace and thank Biden for the meal: All prayers are binding! No take-backs!
  3. Dress the turkey in drag: This turkey died because it couldn't express itself as a chicken.
  4. Throw a Molotov cocktail: Buuuuuurn!
  5. Invite Elizabeth Warren: She can demonstrate how indigenous peoples would hand-shuck corn. With their hands.
  6. Set up a TV screen to play Kamala Harris speeches: There is nothing more compelling than the soothing laugh and eloquent words of Kamala.
  7. Tout all of Biden's accomplishments: Conservatives can't stand hearing about this president's MANY achievements that aren't in any way imaginary.
  8. Talk about how thankful you are for inflation: Higher prices mean everyone has more money! Who wouldn't be thankful for that?
  9. Sit at the kids' table and indoctrinate the young impressionable minds: Set up a PowerPoint presentation to really drive it home.
  10. Show everyone your paid-off student loans: Oh, wait…

Well, most of those will work. Maybe save the student loan thing for next year. By then it will definitely happen. For sure. Or 2024.
